The Divorce, Dissolution and Separation Bill which, when passed, will end the need for fault to be assigned within divorce proceedings has  reached the next stage after MP’s voted in favour after the second reading in the House of Commons.

Current Divorce law means that the Petitioner has to have grounds for divorce on either the basis of their spouse’s Adultery or Unreasonable Behaviour, failing which they have to wait for either 2 years separation (with the consent of their spouse) or 5 years where consent is not available. This can cause additional harm to the already fragile relationship between the parties, and lead to unnecessary additional conflict when dealing with the wider issues around finances and children.

The new bill will remove that need for allegations of fault to be made within the Divorce Petition and hopefully will enable families to reach amicable and constructive agreements in relation to the wider issues, leading to a longer-term improvement in communication in relation to children for example.
