Unfair Dismissal and Wrongful Dismissal Pricing
Our average pricing based on our experience of previous cases for defending claims for unfair or wrongful dismissal which are based on an hourly rate of a senior solicitor of £235 per hour (excluding VAT) are:
Simple case: £2,500 to £7,500 (excluding VAT).
Medium/complex case: £7,500 to £15,000 (excluding VAT).
High complexity case: from £15,000. Usually between £15,000 to £30,000 (excluding VAT).
Please note the above categories and prices are our normal range of prices. If the case develops into a more complex matter than first anticipated as it develops we will discuss with you the possibility of it then falling into a higher category.
There are a number of factors that can cause a case to become more complex.
- Defending a claim that is brought by a litigant in person
- Making or defending a costs application
- Complex preliminary issues such as whether the claimant is disabled (if this has not been agreed by the parties)
- The number of witnesses and documents
- The necessity to make or defend applications to amend claims or provide further information about an existing claim
- If it is an automatic unfair dismissal claim, eg. if you were dismissed after blowing the whistle on your employer
- Allegations of discrimination which are linked to the dismissal
- The number of documents that will have to be disclosed as part of the claim, the number of documents that you are wanting us to process and read
- The length of the employment tribunal
- The number of witness statements
- The actions of your opponent in the claim
There are additional charges for attending a tribunal hearing of £1750 per day excluding VAT.
Generally, we would allow 1-2 days for a simple case and the length of medium to complex cases will depend on the number of witnesses and documents that we have in the claim.
Disbursements
Disbursements are costs related to your matter that are payable to third parties, such as obtaining medical reports if there are allegations put forward of disability. We handle the payments of the disbursements on your behalf to ensure a smoother process.
Counsel’s fees are estimated between £1,000-£2,500 per day (depending on experience of the barrister) for attending a tribunal hearing (not including preparation).
