When you have been injured in an accident due to someone else’s fault, you are entitled to seek compensation. But how much is your injury worth?
The value of an injury claim is based on the pain and suffering you have suffered.
- Pain and Suffering
This refers to the physical and emotional distress caused by your injury. It’s more subjective but can be a significant part of the overall value of your claim. Factors include:
- Severity of the injury
- Duration of recovery
- Chronic pain or disability
- Emotional distress, such as anxiety or PTSD
To assess your injury, we would need to send you to an independent expert whose duty in preparing their expert report is to the court. The expert will review all your medical records, scans, x-rays etc if requested. They will then prepare a report and send it tous for your injuries.
If this report is a final report, then we will value your claim by looking at guidance given to us by the government and previous cases which the courts have decided. We will then give to you a valuation for how much your injury would be worth in compensation.
- Permanent Disability or Disfigurement
Injuries resulting in long-term or permanent effects significantly increase a claim’s value. This includes:
- Scarring
- Loss of limb
- Paralysis
- Any condition that reduces your quality of life
Final Thoughts
The value of an injury claim is not set in stone—it’s often a negotiation between and the insurance company. It is always better to work with a personal injury solicitor as this is the best way to ensure your claim is properly evaluated and you receive fair compensation.
You are entitled to other compensation in an accident claim which we have set out in other articles dealing with what you can claim because of someone else’s fault.
