During your lifetime there is the distinct possibility that you will have to instruct a healthcare professional, either a General Practitioner (GP), someone at a hospital, dentist or other health professional.

When you go to see those health professionals you expect to receive the most professional standards and the highest quality of care.

Most of the time this does happen, but at times it does not.

If you have suffered because the care you have received has not been the care that should have been given to you and it was sub-standard, then you will be entitled to claim for your compensation and losses as a result of the sub-standard care caused to you.

What is clinical negligence?

Clinical negligence is the care that you receive when you go to any healthcare professional if the care you receive is sub-standard by the standards of other healthcare professionals of a similar standing and which causes you harm at the time you receive it.   If this is the case, we will look to bring a claim for you against the healthcare professionals or their employers.

For a successful clinical negligence claim, you have to prove:

  1. You were owed a duty of care; and
  2. The duty of care was breached; and
  3. That this caused some harm to you and you have suffered some damage and/or loss.
