Stages of the process

We deal with the sale and purchase of both freehold and leasehold property.  The precise stages involved vary according to the circumstances.  The keys stages however are as follows:

  1. To take your instructions (usually by telephone or email) and give you initial advice
  2. To issue/ receive contract documents from the solicitor for the buyer/seller
  3. Where you are purchasing a property we will carry out searches and make any necessary enquiries of the seller’s solicitor
  4. Where you are selling a property we will deal with any enquiries raised by the buyer’s solicitor
  5. Where mortgage finance is being obtained for a purchase we will receive a copy of your mortgage offer and go through the main provisions with you
  6. To advise you on the contract paperwork and liaise with the other side’s solicitor to agree a mutually convenient completion date
  7. To exchange contracts once the above stages are complete. This will make the transaction legally binding.
  8. To organise the transfer of funds on the day of completion
  9. To deal with post completion formalities such as the discharge of any existing mortgage; registration of Title with Land Registry, payment of Stamp Duty Land Tax (SDLT, in England) or Land Transaction Tax (Land Tax, in Wales) and, in the case of the purchase of a leasehold property, notifying the Landlord of the change of ownership;

How long will it take?

The length of time from acceptance of an offer to completion depends on a number of factors.  The average process takes 2 to 3 months.  It can be quicker or slower depending on the parties in the chain and the complexity of the transaction.
